They are so enamored by their trees that they have certain rules and regulations when it comes to removing one of those trees. However, it’s not as strict as many cities across the Puget Sound. A tree permit is only required when construction activities are planned, or if the tree sits in a critical tree area.

A tree permit is not required for:

  • Normal pruning and maintenance limited to no more than 25% of the trees total leaf area.
  • Small trees unless it’s a landmark tree.
  • Cutting trees on a private lot in a residential zone unless the tree is because of construction work, located in a critical tree area, designated at landmark tree or within a landmark Grove. (Be sure to check with the city of Mercer Island if you are unsure).
  • Emergency tree removal such as those involving immediate danger to life or property. The city arborist must be notified within seven days of tree cutting and must be provided with information that verifies the emergency condition. This could be after a storm cleanup or some damage that may have happened.

PERMIT REQUIREMENTS

  • A permit is required if you’re doing any type of construction work. If you are clearing trees to make room for construction or an improvement to the property you will need a permit.
    You will need a permit if you want to take down a tree in a critical tree area. These could be geologic hazard areas, a protected slope area, a watercourse corridor or a wetland.
  • A commercial zone.
  • Landmark a tree or Grove. This landmark designation can only be affixed with the approval of the property owner.
